1. Agreement to Terms

By accessing or using Subtide ("Service", "Platform", "we", "us", or "our"), operated by Andre Schweighofer, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.

The Service is intended for users who are at least 18 years of age. By using this Service, you represent and warrant that you are at least 18 years old.

2. Description of Service

Subtide is a platform that connects breathwork teachers with students through multi-day breathwork journeys. Teachers create and publish breathwork content, including videos and audio files. Students enroll in journeys via invitation links and progress through daily content.

Medical Disclaimer: Breathwork practices may not be suitable for everyone. Users with cardiovascular, respiratory, or mental health conditions should consult a physician before participating in any breathwork practices. Subtide is a platform for content delivery and assumes no responsibility for the safety or medical appropriateness of breathwork practices offered by teachers.

3. User Accounts and Responsibilities

3.1 Teacher Accounts

Teachers who create accounts on Subtide are responsible for:

  • Ensuring all content uploaded is original, properly licensed, or used with permission
  • Ensuring their breathwork instructions are safe, appropriate, and professionally sound
  • Complying with all applicable laws and regulations in their jurisdiction
  • Maintaining the security and confidentiality of their account credentials
  • Not uploading content that is offensive, illegal, or violates third-party rights

3.2 Student Accounts

Students who enroll in journeys are responsible for:

  • Ensuring they are physically and mentally capable of participating in breathwork practices
  • Following any medical advice or warnings provided by teachers
  • Maintaining the security and confidentiality of their account credentials
  • Accepting participation agreements (waivers) before accessing journey content

4. Content Ownership and License

4.1 Teacher Content

Teachers retain all ownership rights and intellectual property in the content they upload to the Platform (including videos, audio files, text, and images). By uploading content, teachers grant Subtide a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and distribute their content solely for the purpose of operating and providing the Service.

4.2 Student Data

Subtide retains control of all student personal data collected through the Platform, including email addresses, consent records, and progress information. Teachers may view student progress through the Platform but may not export or independently process student personal data outside the Platform, except as described in Section 5 below.

Teachers may export anonymized, aggregated analytics data (e.g., "15 students completed Day 3") but not individually identifiable student information.

5. Email Sharing and Communications

When enrolling in a journey, students may choose to opt-in to share their email address with the teacher who created that specific journey. This consent is:

  • Voluntary and optional - students can decline to share their email
  • Specific to each journey - consent applies only to the journey being enrolled in
  • Revocable at any time by contacting us at the email address provided in Section 13

By opting in, students explicitly consent to the teacher receiving and using their email address for direct communication related to the journey.

6. Content Standards and Acceptable Use

Teachers must ensure all uploaded content:

  • Is relevant to breathwork practices and educational purposes
  • Does not contain nudity, sexually explicit material, or offensive content
  • Does not violate copyright, trademark, or other intellectual property rights
  • Does not contain malware, viruses, or harmful code
  • Complies with file size and storage limits set by the Platform

We reserve the right to remove any content that violates these standards without prior notice.

7. Teacher Liability for Content

Teachers are solely responsible for the content they create and publish on the Platform. Subtide is not liable for:

  • The safety, accuracy, or appropriateness of breathwork instructions provided by teachers
  • Any injuries, harm, or damages resulting from students following teacher-provided instructions
  • Any copyright, trademark, or intellectual property violations in teacher-uploaded content
  • Any misrepresentations, errors, or omissions in teacher-created content

Teachers agree to indemnify and hold harmless Subtide from any claims, damages, or liabilities arising from their content.

8. Subscription and Payment Terms

Teachers may be required to maintain an active subscription to publish and distribute journeys on the Platform. Subscription pricing and payment terms are displayed on our pricing page and may be updated from time to time. We will provide reasonable notice of any pricing changes.

9. Data Retention

We retain user data (including student email addresses, consent records, and progress information) for as long as accounts remain active and for a period of three (3) years following the last journey activity. This retention period allows teachers to access historical data and students to review past journeys.

Users may request deletion of their personal data at any time by contacting us. Upon receiving a deletion request, we will delete or anonymize personal data in accordance with applicable data protection laws.

10. Account Termination

You may terminate your account at any time by contacting us. We may suspend or terminate accounts that:

  • Violate these Terms of Service
  • Upload inappropriate, illegal, or infringing content
  • Engage in fraudulent or abusive behavior
  • Remain inactive for extended periods

Upon account termination, your access to the Service will cease, but certain data may be retained as described in our Privacy Policy and Section 9 above.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUBTIDE AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use of or inability to use the Service
  • Any content obtained from the Service, including teacher-provided breathwork instructions
  • Unauthorized access to or alteration of your data or content
  • Any injuries, damages, or health issues resulting from breathwork practices

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

12. Dispute Resolution and Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Austria.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Service after such changes constitutes your acceptance of the updated terms.
